ORDER
By this application, the plaintiff seeks to substitute the current second defendant, Ashok Kumar, with Janus Koncepts and implead Sachin Kumar, Head of Operation, Janus Koncepts, as the third defendant in the suit.
2. The suit was filed alleging infringement of the plaintiff's trade marks by posting content on the platform of the first defendant. The first defendant provided information pertaining to the proposed defendants. This application is consequential thereto.
3. Given the fact that the first defendant is merely the intermediary and it is the proposed defendants, who are the alleged infringers, it is just and necessary that they be impleaded. In spite of notice being served on the proposed defendants on 27.06.2025 and their names being printed in the cause list, there is no representation for the proposed defendants.
4. Therefore, this application is allowed as prayed for by directing that the proposed defendants be impleaded as the second and third defendants in the suit. The plaintiff is directed to carry out the amendments in the plaint on or before 06.08.2025 and serve a copy of the amended plaint on the other parties.
