ORDER

This Criminal Original Petition has been filed seeking a direction to the learned Principal District and Sessions Judge, Erode accept the surrender of the petitioner and to consider his bail application on the very same day in respect of Crime No.96 of 2026 on the file of the respondent Police.

2. Heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (Crl. Side) appearing for the first and second respondents.

3. It is evident from the records that a land dispute exists between one Sivakumar and the first accused. The defacto complainant has taken the subject property on lease from the said Sivakumar. The property has been properly fenced, however, the accused damaged the same. When the defacto complainant questioned the act, he was assaulted and abused by the accused. Therefore, an FIR came to be registered in Crime No.96 of 2026, wherein, the petitioner has been arrayed as ninth accused.

4. In view of the above factual position, there shall be a direction to the learned Principal District and Sessions Judge, Erode to consider the petitioner's bail application, preferably on the same day of his surrender, in connection with

Crime No.96 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioner shall surrender before the jurisdictional Court concerned within a period of fifteen days from the date of the receipt of a copy of this order.
