This is the third bail petition and the second petition was dismissed by this Court on 01.10.2015.
2. It is seen that after the dismissal of the first petition, the co-accused has been granted bail by the Sessions Court in Crl.MP.No.3099 of 2015 on 16.10.2015. Since the petitioner is in incarceration from 26.08.2015, this Court is of the view that it is a fit case to grant bail.
3. Accordingly, the petitioner is directed to be released on bail, on condition that the petitioner shall execute a bond for a sum of Rs.25,000/- [Rupees twenty five thousand only] with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate-II, Ponneri and the petitioner shall stay at Gandhi Ashram, Madurai and take part in the activities of Ashram for a period of four weeks. [a] Thereafter, the petitioner shall report before the respondent police daily at 10.30 a.m. for a period of two weeks and thereafter, as and when required for interrogation.
[b] The petitioner shall not tamper with evidence or witness either during investigation or trial.
[c] The petitioner shall not abscond either during investigation or trial. [d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law, as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji Vs. State of Kerala [(2005)AIR SCW 5560]. 30.10.2015 gya
