ORDER

The petitioner apprehends arrest for the alleged offence under Sections 303(2), 326(a) of BNS 2023, in Crime No.195 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The allegation against the petitioner is that on 23.12.2025, the petitioner illegally transported 60 kgs of river sand in three cement bags in a TVS 100 Heavy Duty bearing Registration No. TN 01 BA 3171 without any valid permission. On seeing the de facto complainant, the petitioner escaped from the scene of occurrence. Hence, the case.

3. Learned counsel for the petitioner submitted that the petitioner is an innocent person and has been falsely implicated in this case by the respondent police and prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and, on instructions, submitted that 60 kgs of river sand had been illegally extracted from the river and that the petitioner has one previous case similar in nature pending against him. Hence, he opposed to grant anticipatory bail to the petitioner.

5. From the submissions made by the learned Government Advocate (Crl.Side), it is seen that the petitioner has one previous case of the same nature, which clearly demonstrates that the petitioner has misused the liberty granted by this Court. Therefore, this Court is not inclined to enlarge the petitioner on anticipatory bail.
