ORDER

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 4(1) (aaa) and 4 (1-A) of Tamil Nadu Prohibition Act in Crime No.358 of 2019, on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complainant is that on 18.07.2019, when the respondent was on usual rounds the petitioner was in possession of 33 boxes each containing 180 ml and 1564 bottles from Pondy. Hence, the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that the petitioner was illegally found in possession of 33 boxes each containing 180 ml and 1564 bottles from Pondy. He would further submit that there are five previous cases as against the petitioner. However, he opposed for grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and submissions of the learned Counsel and also the fact that there are five previous cases as against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
