This Petition has been filed to condone the delay of 40 days in filing the above CMA.SR.No.173124 of 2024.

2. Heard the learned counsel for the appellant and perused the material available in the record.

3. On being satisfied with the averments stated in the affidavit filed in support of the petition, and finding the reason assigned by the petitioner to be justifiable, the interest for the default period is ordered to be waived. Therefore, the delay in filling CMA.SR.No.173124 of 2024 is condoned.

4. Accordingly, this Civil Miscellaneous petition is allowed.
