O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8 (C), 20 (b) (ii), 29(1) of NDPS Act, in Crime No.149 of 2020, seeks anticipatory bail.

2. The case of the prosecution is that on 13.02.2020, the respondent police received an information from the informer that the petitioner along with the other accused attempting to sell Kanja at Puliyanthope. On seeing the respondent Police, they ran away from the scene of occurrence. However, the Police caught the other accused and seized 1 1/2 Kgs Kanja from them. Hence, the complaint.

3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely https://hcservices.ecourts.gov.in/hcservices/

implicated in this case.Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner has been arrayed as accused No.3 in this case. He along with the other accused were found in possession of 1 1/2 Kgs of Ganja. The respondent apprehended the other accused and the petitioner escaped from the scene of occurrence. The petitioner is involved in many other NDPS cases. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration of the facts and circumstances of the case and the fact that the petitioner has already been involved in many other NDPS cases, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
