The petitioner along with the minor boy Pradeep are present in the court.
2. This petition has been filed under Sections 3, 7 to 10 of Guardian and Wards Act read with Clause 17 of the Letters Patent Act, 1865 and Order XXI Rules 2 and 3 of O.S.Rules, for appointment of the petitioner as guardian for minor child Pradeep.
3. The minor child Pradeep is the brother of the petitioner, who was born on 17.08.2013 aged about 11 years, studying 6th standard whose father died on 01.10.2021 and their mother died on 30.08.2021. The petitioner and her minor brother Pradeep are the surviving legal heirs of their deceased parents. The petitioner, aged about 20 years, is major and is working as salesgirl in a mobile shop and earning a monthly salary of Rs.20,000/-. The petitioner and her minor brother are living at No.2A, Ambedkar Street, Periyar Nagar, Thirunindravur - 602 024, Tiruvallur District.
4. The petitioner is the eldest sister of the minor boy. The petitioner has Page No:1/3
stated that in order to avail Prime Minister CARES for Children Scheme, she had applied for the guardianship for her brother. She examined herself as PW1. The death certificate of their father Sakthivel is marked as Ex.P5, the death certificate of their mother is Ex.P6, their legal heirship certificate is Ex.P7, photocopy of the family card of the deceased father Sakthivel is Ex.P8 and hence taking into consideration the welfare of the minor in respect of the person and property, this court deems it fit to appoint the petitioner as the guardian of the minor boy Pradeep, whose date of birth is 17.08.2013 for the person and property and the petitioner is permitted to receive scholarship amount through the bank account and spend the same for the welfare of the minor.
