2 RAMASAMY Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw the entire award amount with accrued interest deposited by the respondent in the credit of MCOP.No.1719/2014 on the file of Special Sub-Court Cum Motor Accident Claims Tribunal, Dharmapuri (in CMP.No.18120/2017) pending disposal of the above CMA.No.1035/2017. Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.M.SELVAM, Advocate for the petitioner and of M/S.C.PARANTHAMAN, Advocate for the 1st respondent the court made the following order:- The petitioner has come forward with this petition to permit the petitioner to withdraw the entire award amount with accrued interest deposited by the 1st respondent-Insurance Company in the credit of M.C.O.P.No.1719/2014 on the file of Special Sub-Court cum Motor Accident Claims Tribunal, Dharmapuri, pending disposal of the above C.M.A.No.1035 of 2017.

2. Heard both sides.

3. Considering the facts and circumstances of the case, the petitioner is permitted to withdraw 50% out of the award amount deposited in the credit of M.C.O.P.No.1719/2014.

4. This petition is allowed on the above terms. -sd/- 18/01/2018 / TRUE COPY / Sub-Assistant Registrar ( Statistics / C.S. ) High Court, Madras - 600 104.
