ORDER

This Writ Petition has been filed for the following reliefs:- "directing the third respondent to consider the representations of the petitioner dated 28.03. 2024 and 09.09.2024 to disburse the revised contractual remuneration to the petitioner together with 18 percentage interest per annum on the differential consolidated pay from their respective dates on which they felt due to the petitioner till date of disbursement." Brief Facts:-

2. The petitioner was initially appointed an an Agricultural Instructor on 19.11.1973 under the Government of Puducherry. He was thereafter deputed to the first respondent Society as Assistant Professor to work at the 3rd respondent college and subsequently permanently absorbed as an Assistant Professor. He served in the third respondent College till attaining the age of superannuation and retired from service on 31.08.2012.

3. Thereafter, the petitioner was re-engaged on a contractual basis as a Post Graduate Teacher for the period from 26.10.2015 to 14.05.2017. As per the terms of re-engagement, he was entitled to a consolidated remuneration

equivalent to his last drawn pay less pension, which was to remain unchanged during the period of engagement.

Subsequently, by proceedings dated 18.04.2023, the third respondent revised the pay scales applicable to the petitioner's regular service and fixed his pay at Rs.68,980/- as on the date of his retirement, i.e., 31.08.2012. According to the petitioner, in view of the revised pay fixation, he became entitled to a corresponding revision of the consolidated remuneration paid during his period of re-engagement.

Therefore, the petitioner had submitted several representations the last of which was dated 09.09.2024 to the third respondent seeking revision of his consolidated remuneration for the period of re-engagement and payment of the consequential arrears. He also pointed out that certain arrears determined pursuant to earlier proceedings had not been disbursed. However, despite the repeated representations, the respondents had failed to consider his request. Hence, the present Writ Petition.

6. Heard the learned counsel on either side.

7. Considering the limited relief sought for by the petitioner and taking note of the fact that the petitioner's representation dated 09.09.2024 has not

been considered to date, the Writ Petition is allowed. The 3rd respondent is directed to consider and pass orders on the petitioner's representation dated 09.09.2024 on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
