and A.No.2479 of 2024 KRISHNAN RAMASAMY, J., This Arbitration Original Petition has been filed under Section 34 of the Arbitration and Conciliation Act, 1996 (hereinafter called as "the Act") to set aside the award dated 28.11.2023.

2. The learned counsel for the petitioner as well as the respondent would submit that the main request of the petitioner is to restrain the respondent from using the undeveloped share of land, where the flats are constructed and allotted to 1235 owners.

3. Further, they would submit that the aforesaid issue was already raised before the learned Arbitrator in I.A.No.1 of 2020 in Arb.No.5 of 2019, wherein an award was passed on 16.06.2020. Challenging the said award dated 16.06.2020, an appeal in CMA.No.1188 of 2020 has been 1/3

filed before this Court and the said appeal was disposed off vide order dated 27.07.2020. Hence, both the learned counsel request this Court that the said order dated 27.07.2020 may continue until further orders passed by this Court in this petition.

4. In view of the above submissions made by both the learned counsel, this Court direct both the parties to comply with the order dated 27.07.2020 passed in CMA.No.1188 of 2020 until further orders.

5. Post this matter on 09.07.2024.
