ORDER : The Court Made the following order :- The petitioners who apprehend arrest at the hands of respondent police for an offence under Section 379 IPC in Crime No.969 of 2020, seek Anticipatory bail.
2. The case of the prosecution is that the petitioners were robbed the defacto complainant for a sum of Rs.5,000/- and escaped from the scene of occurrence. Hence a case has been registered against the petitioners.
3. It is seen from the records that this is the second anticipatory bail petition filed by the petitioners. The previous order, dismissing the Criminal Original petition in Crl.O.P.No.4178 of 2021 was passed by this Court on 08.03.2021.
4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous order was passed on merits and the investigation is yet to be completed and further there are three previous cases pending against the petitioners. Hence, the learned Government Advocate vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
5.In view of the submission made by the learned Government Advocate, further no change of circumstances arises for considering second anticipatory bail. Hence, this Criminal Original petition is dismissed.
