ORDER

This petition is filed for a direction to the second respondent to register the case based on the complaint dated 24.04.2015 forwarded through proceeding in C.No.533/CCB/Visitors/2015 and investigate the same and file a final report.

2.The petitioner herein lodged a complaint as against one Ganesan and his son Arunprasanna stating that the said persons have collected a huge amount of Rs.1 Crore promising to get permission for quarrying in Thottyam village and they misappropriated the said amount. Though the complaint has been lodged as early as on 24.04.2015, till date no action has been taken. Hence, this petition.

3.The learned Additional Public Prosecutor would submit that earlier a complaint was lodged by one Rajappa for similar nature https://hcservices.ecourts.gov.in/hcservices/

of offence in the year 2014 and based on his complaint FIR has been registered and would further submit that this is another occurrence and the respondents are ready to enquire into the matter and proceed further in accordance with law in respect of the present complaint also.

4.I have heard the learned counsel appearing for the petitioners as well as the learned Additional Public Prosecutor. 5.In view of the submissions made by the learned Additional Public Prosecutor, this Court directs the second respondent to conduct enquiry on the complaint lodged by the petitioner dated 24.04.2015 and upon enquiry, if materials are gathered indicating commission of any cognizable offence, is directed to proceed further in accordance with law, as early as possible. 6.With the above directions, the Criminal Original Petition is disposed of.
