ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.09.2025 for the alleged offences under Section 8(c) read with 20(b)(ii)(C) of NDPS Act, 1985 in Cr. No.458 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that based on a secret information, on 11.08.2022, while the respondent police party proceeded towards Damarapatti Junction and kept surveillance near the Kuruvinayanapalli Police Toll Check Post, at about 8 a.m., a Tata Sumo Gold vehicle bearing Registration No.AP02 BA 4782 was intercepted and upon search, it was found that the occupants in the said vehicle, A1 and A2, were found in illegal possession of 100 kgs of Ganja and hence the case.

3. There is no representation on behalf of the petitioner.

4. The learned Government Advocate (Criminal side) appearing for the respondent police would submit that the petitioner has been enlarged on statutory bail vide order passed by the Additional District Judge and Presiding Officer, Special Court under EC Act in Crl. M.P. No.209 of 2026.

5. While looking at the factual position of the order, in a case where 100 kilograms of Ganja was recovered, the respondent police were very careless in filing the charge sheet and on account of non-filing of the charge sheet, the petitioner was enlarged on statutory bail. This Court views such conduct of the respondent police with consternation and deem it appropriate to bring to the knowledge of Director General of Police. Therefore, this Court directs the learned Government Advocate to bring such lapses to the Director General of

Police for taking appropriate action, if there is any lapse on the part of the respondent police. Registry is also directed to send a copy of the order to the Director General of Police.

6. Further, in view of the enlargement of the petitioner on statutory bail, the present Criminal Original Petition is disposed of. 05-06-2026 MJS Note:
