ORDER
Alleging that the order of this Court dated 13.06.2022, in Crl.O.P.No.13651 of 2021 has not been complied with, the petitioner has approached this Court.
2/4 2.It is the case of the petitioner that he had filed Crl.O.P.No.13651 of 2021 seeking to direct the second respondent to provide necessary police protection to his life and property and to survey his land with the help of a Taluk Surveyor. This Court, by an order dated 13.06.2022, allowed the same. 3.When the matter was taken up for hearing, the learned Additional Public Prosecutor submitted that this Court, vide order dated 13.06.2022 in Crl.O.P.No.13651 of 2021, had directed the respondents 1 and 2 to take effective steps to protect the Revenue Authorities and the Surveyor in their lawful act of measuring the lands and effecting the name transfer in the Patta. He further submitted that the order of this Court has been complied with and survey has been conducted and an affidavit has also been filed by the second respondent in this regard.
4.The relevant paragraphs of the affidavit are extracted hereunder: 4.It is submitted that based on the above said order, on 17.10.2024, the Surveyor, Uthankarai, the Village Administrative Officer and the Village Assistant, Eggoor Village and his assistance were surveyed the petitioner Madhaiyan's land in Survey No.65/1 to an extent of 0.96 acres and an extent of
3/4 1.04 acres in Survey No.64/4E totally to an extent of 2 acres situated at Eggoor Village, Uthankarai Taluk, Krishnagiri District, during that time, myself along with my team viz., Tr.Saravanan, Sub Inspector of Police, Tr.Senthil, Special Sub Inspector of Police, Tr.Arivumani, Gr-I, 1835, Tr.Arivazhagan, Gr-I 1715, Tr.Anbarasu, Gr-I, 1581, Tr.Nehru, Gr-I, 1723 and Tr.Muthu Kumaravel, Gr-I, 1875 were given adequate police protection to survey the land.
5.It is submitted that the said Surveyor, Uthankarai, the Village Administrative Officer and the Village Assistant, Eggoor Village and his assistance were recorded the statement of the petitioner/Madhaiyan in the presence the petitioner's wife Tmt.Uma and public and the same was acknowledged by them.
