Writ Petition filed under Article 226 of the Constitution of India for the relief of issuance of Writ of Mandamus directing the respondent to consider the representation of the petitioner dated 17.07.2015 requesting for the grant of permission to shift the present terminus from Karumathampatti Nalroad to Somanur Bus Stand and to operate the vehicle as usual and pass orders thereon forthwith.

ORDER

The petitioner claims to be an authorised minibus operator. According to him, he has been issued with a permit by the respondent to operate the minibus service between Karumathampatti Nalroad to Selambarayanpalayam.

It is the further case of the petitioner that Somanur is a growing commercial and marketing centre with several power-loom production units and the people residing between Karumathampatti and Salembarayanpalayam need all the way to go to Somanur to fulfil their commercial needs besides their routine employment needs. There is no direct link between the said place and Somanur and the present place where the bus terminus is now located is a busy junction and every day, the commuters besides local general public experience much difficulties owing to traffic congestion. In those circumstances, the petitioner wanted the authority to shift the bus terminus to Somanur.

3. The grievance of the petitioner is that despite repeated oral requests and a representation made in writing to the petitioner on 17.07.2015, there was no response. Hence, this writ petition.

4. Heard Mr.T.Padmanabhan, the learned counsel for the petitioner and Mr.M.S.Ramesh, who takes notice for the respondent and also perused the available records carefully.

5. Considering the limited scope of the prayer sought for in the writ petition and the fact that the representation of the petitioner dated 17.07.2015 for shifting of the present bus terminus from Karumathampatti Nalroad to Somanur Bus Stand is still pending with the respondent, without expressing any opinion on the merits of the case, this court directs the respondent to consider the representation of petitioner dated 17.07.2015 on merits and in accordance with law and pass appropriate orders on the same within a period of eight weeks from the date of receipt of a copy of this order.
