ORDER

According to the counsel appearing for the petitioner, a show cause notice has been served to the petitioner on 28.8.2019 and the petitioner submitted an explanation to the respondent and no inspection was conducted by the respondent before passing the impugned order withdrawing the recognition of B.Ed. Course granted to the petitioner. Therefore, counsel appearing for the petitioner seeks to set aside the impugned order by considering his representation.

2. The learned Standing counsel appearing for the respondent denied the allegation made by the petitioner and stated that the petitioner College was given sufficient opportunities by the respondent to submit their explanation and https://hcservices.ecourts.gov.in/hcservices/

the explanation submitted by the petitioner was not disputed. If the petitioner is aggrieved, they can file an appeal before the appellate authority.

3. According to the Standing counsel appearing for the respondent, if the petitioner is aggrieved by the impugned order, the petitioner has to prefer an appeal before the Appellate authority. In response to the aforesaid contention, the learned counsel appearing for the petitioner fairly submitted that they will prefer an appeal before the Appellate authority within two weeks from the date of receipt of copy of this order.

4. Taking note of the submissions made by the counsel appearing for the parties, this Court is inclined to pass the following order:

(i) The petitioner is permitted to file an appeal before the Appellate Authority within two weeks from the date of receipt of a copy of this order;

(ii) The Appellate authority shall consider the appeal to be filed by the petitioner and take final decision after providing opportunities to the petitioner as per the guidelines of the respondent and to pass appropriate orders in accordance with law, as expeditiously as possible preferably within a period of four weeks from the date of receipt of a copy of this order.

5. The writ petition stands disposed of with the above directions. No Costs. Connected miscellaneous petition is closed.
