The petitioner has filed this petition to call for the records on the file of the respondent issued in the proceedings in No.Na.Ka.475/2012/Sa.Pa dated Page No.1 of 5
30.06.2012 and quash the same.
2. The case of the petitioner is that the petitioner was initially appointed as Junior Inspector through TNPSC on 04.08.1986, rose through the ranks to become a Deputy Registrar/Managing Director of the Thiruchengode Co-operative Urban Bank. During his service, he was deputed as the full-time Special Officer of the District Co-operative Printing Press and was additionally in charge of several Primary Agricultural Cooperative Societies, including the Sevvanthipatti Society. During his tenure as Special Officer (in-charge) of Sevvanthipatti Society, the then Secretary, Thiru. K.Mathialagan, allegedly misappropriated large sums of money, including Rs.10,42,752/- and Rs.9,25,000/-, by falsifying records. Thiru, Mathialagan passed away in January, 2011. The petitioner contends that he is not responsible for the financial irregularities, citing his heavy workload and the fact that, as per the society's bye-laws, the Secretary alone is accountable for the financial management. Hence, this case.
3. Though many grounds have been raised in this writ petition, learned counsel for the petitioner submitted that it would suffice if this Court issues direction to the respondent to consider the petitioner's representation dated Page No.2 of 5
09.01.2025 on merits, in accordance with law, within a time frame to be fixed by this Court.
4. Learned Additional Government Pleader appearing for the respondent has no objection for the said order being passed by this Court.
5. Heard the learned counsel on either side and perused the materials available on record.
6. Considering the limited relief sought for by the learned counsel for the petitioner, this Court without going into the merits of the case directs respondent to consider the petitioner's representation dated 09.01.2025, after giving due notice to the petitioner, affording an opportunity of personal hearing and considering the documents filed by the petitioner on merits, in accordance with law and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of this order.
7. This writ petition is disposed of with the aforesaid observation and directions. No costs. Consequently, connected miscellaneous petition is also closed.
