(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294 (b), 332, 506 (ii), 307 of IPC r/w. 4 (1) (a) of TN Prohibition Act in Crime No.1368 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that based on the information received, on 31.08.2020, the respondent police while patrolling found the accused selling illicit liquor. When they attempted to arrest the accused, they assaulted the police with an iron rod as a result of which the police sustained injuries.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Therefore, he prays for grant of anticipatory bail to the petitioner.

4.The learned Additional Public Prosecutor would submit that based on the information, the respondent police while patrolling found the accused selling illicit liquor. When they attempted to arrest the accused, they assaulted the police with an iron rod as a result of which the police sustained injuries. A2 and A3 are still in custody. He further submitted that there are six previous cases as against the petitioner. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case and also the fact that there are six previous cases as against this petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
