PRAYER:

Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus to direct the respondents herein to consider the representation of the petitioner the last of which was on 23rd September, 2017. and to pass suitable orders thereon and communicate the same to the petitioner in accordance with law.

O R D E R

The petitioner seeks for a mandamus directing the respondents to consider his representation dated 23.09.2017, wherein and whereby, he sought for payment of compensation towards the land acquired by the respondents under the National Highways Act.

2. The grievance of the petitioner is that even though such land was acquired by the respondents and such acquisition was not opposed by the petitioner, the respondents have not paid the compensation so far nor communicated any order to the petitioner indicating the passing of any award in respect of the subject matter of acquisition.

3. Learned Special Government Pleader is not in a position to inform this Court as to whether any award is passed by the respondents so far. Therefore, this writ petition is disposed of only by directing the respondents to consider the representation of the petitioner and pass orders on the same and communicate the decision taken to the petitioner within a period of four weeks from the date of receipt of a copy of this order also by indicating as to whether any award is passed in respect of the subject matter of acquisition and if any such award is passed, the respondents are directed to furnish a copy of such award to the petitioner so as to enable him to seek for enhancement of compensation, if the petitioner is not satisfied with the award already passed. The entire exercise shall be done by the respondents within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
