O R D E R

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 20.08.2020 for the offence punishable under Section 399 IPC, in Crime No.90 of 2020, on the file of the respondent police, seeks bail.

2. The case of the prosecution as per the defacto complainant as per the defacto complainant Dinesh Kumar, Sub Inspector of Muthupettai Police Station is that on 19.02.2020, the petitioner along with other accused was making preparation to commit robbery. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for from 20.08.2020. Hence, he seeks for grant of bail to the petitioner.

4.The learned Government Advocate (Criminal Side) would submit that the petitioner is a habitual offender and he has involved in two previous cases. He would further submit that the petitioner hails from Tirunelveli and that he has come all the way to commit the offence. Hence, he vehemently opposed for the grant of bail to the petitioner.

5.Taking into consideration of the facts and circumstances and the submissions made by the learned counsels and that the petitioner has been arrested very recently on 20.08.2020, this Court is not inclined to grant bail to the petitioner for the present.
