Respondent/Appellant/Plaintiff Prayer: The second appeal has been filed under Section 100 of Civil Procedure Code against the Judgment and decree dated 02.07.2015 made in A.S.No.18 of 2014 on the file of the Subordinate Court, Namakkal, reversing the judgment and decree dated 18.09.2013 made in O.S.No.23 of 2010 on the file of the Principal District Munsif Court, Namakkal.

JUDGMENT

The counsel for the appellant seeks permission of this Court to withdraw the second appeal and undertakes to file a memo to that effect.

In the light of the abovesaid position, the second appeal is dismissed as withdrawn and the counsel for the appellant is directed to file a memo to that effect immediately. Consequently, connected miscellaneous petition, if any, is closed.
