Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the respondents to consider and pass orders on the petitioner's representation dated 18.08.2017 within a stipulated period of time.

Mr.P.V.Selvakumar, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.
2. The petitioner seeks for a mandamus directing the respondents to consider his representation dated 18.08.2017, wherein and whereby he sought for permission to remove the process sand from a particular place.
3. Perusal of the said representation would clearly indicate that in respect of the same cause of action, the petitioner already approached the Civil Court and filed O.S.No.17 of 2017 on the file of the District Munsif Court, Namakkal and seems to have obtained some interim order as well. When that being the factual position, I do not think that the petitioner can file this writ petition before this Court, seeking for disposal of the said representation, which in my considered view, is not maintainable, since already there is an interim order of the Civil Court operating in the above said suit. Accordingly, this writ petition is dismissed as not maintainable.
