The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1-A), 4(1)(aaa), 4(1)(g) of Tamil Nadu Prohibition Act, in Crime No.128 of 2023, seeks anticipatory bail.

2. The case of the prosecution as per the defacto complainant when they conducted inspection, at that time the petitioner was found to be in possession of 750 litres of ID arrack and 2500 litres of fermented wash and on seeing the respondent police, the petitioner ran away from the scene of occurrence. Hence, the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would also submit that the petitioner is ready to abide by any stringent condition that may be imposed on him. Hence, he would prays for the grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the petitioner was found to be in possession of 750 litres of ID arrack and 2500 litres of fermented wash. He would further submit that in that petitioner area, very recently a hooch tragedy had happened and the custody of the petitioner is very much required for investigation. However, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration, the custodial interrogation of the petitioner is required on account of the hooch tragedy, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
