Mr.C.Meera Arumugam,AGP For R1 to R3 Mr.Arasakumar Govt.Advoacte For R4 ND/W -R5 -Pvt Order This writ petition has been filed to direct the fourth respondent to cancel the layout approval for the property, morefully disclosed in the affidavit filed in support of this writ petition granted in favour of the fifth respondent. 2.Pursuant to the representation of the petitioner, proceedings have already been initiated by the fourth respondent on the petitioner's request for cancellation of the layout approval. The fifth respondent has already been put on notice in the enquiry proceedings conducted by the fourth respondent. Till date, no final order has been passed by the fourth respondent on the petitioner's representation seeking for cancellation of layout approval granted in favour of the fifth respondent for the property, morefully disclosed in the affidavit filed in support of this writ petition.
3.The petitioner has filed supporting documents along with this writ petition in support of the prayer sought for in this writ petition. This Court is not expressing any opinion on the merits of the same.
4.Ms.C.Meera Arumugam, learned Additional Government Pleader accepts notice on behalf of respondents 1 to 3. Mr.Arasa Kumar, learned Government Advocate accepts notice on behalf of the fourth respondent. Since no adverse order is being passed against the fifth respondent, notice to the fifth respondent is dispensed with by this Court.
5.No prejudice would be caused to the respondents if a direction is issued to the fourth respondent to pass final orders, on merits and in accordance with law on the petitioner's representation seeking for cancellation of the layout approval granted to the fifth respondent for the property, morefully disclosed in the affidavit filed in support of this writ petition, after giving due consideration to the supporting documents produced by the petitioner as well as after hearing the objections of the fifth respondent, within a time frame to be fixed by this Court.
6.This Court is not expressing any opinion on the merits of the petitioner's representation.
7.For the foregoing reasons, this writ petition is disposed of by directing the fourth respondent to pass final orders, on merits and in accordance with law on the petitioner's representation seeking for cancellation of the layout approval
granted in favour of the fifth respondent for the property, morefully disclosed in the affidavit filed in support of this writ petition, after giving due consideration to the supporting documents produced by the petitioner and after hearing the objections of the fifth respondent, within a period of 8 weeks from the date of receipt of a copy of this order. No costs.
