Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of declaration declaring the allotment given by the third respondent in favour of the fourth respondent by placing him under Extreme Backward Class Category (E.B.C.) meant for natives / residents of the Union Territory of Puducherry, in the Biology based courses Merit List (2015-2016) issued by the Centralized Admission Committee, the third respondent herein, as the one illegal against reservation policy and consequently direct the third respondent to allot the petitioner herein for the admission to Biology Based courses Merit List (2015-2016).

O R D E R
This writ petition has been filed by the petitioner on a premise that the fourth respondent is not entitled to get the post, as the admission has been made by producing false documents. https://hcservices.ecourts.gov.in/hcservices/

When this matter is taken up for hearing today, the learned Government Advocate appearing for the respondents 1 and 2 / official respondents submitted that, after the filing of the writ petition and on receipt of the documents pertaining to the fourth respondent, a show cause notice was issued by the second respondent in Proceedings No.3311/TOP/B/2015, dated 22.09.2015, to the fourth respondent and to the said show cause notice, the fourth respondent has given a reply stating that in view of the pendency of the writ petition, he is unable to give his reply, on merits.
3. Now that the second respondent has already initiated proceedings by issuing the show cause notice dated 22.09.2015. Therefore, it is suffice to direct the said authority to conclude the same within a period of two weeks from the date of receipt of a copy of this order. The fourth respondent shall give, all his possible reply, within a period of one week from the date of receipt of a copy of this order. Before passing the order, the second respondent shall also hear the petitioner. Based upon the decision of the second respondent, the third respondent shall act further in this matter. It is needless to state that the second respondent shall pass the reasoned order, after considering the documents filed by the parties on either side.
4. This writ petition is disposed of accordingly. No costs. Consequently, the connected MP is closed.
