Petition praying that in the circumstances stated therein the High Court will be pleased to modify the condition imposed by this Court in Para 6(b) of the order dated 27.04.2021 passed in Crl.OP.No.5132/2021 as the petitioner shall deposit a sum of Rs.5,00,000/- to the credit of Cr.No.429/2021 before the Judicial Magistrate No.I, Namakkal. On such deposit being made, the Magistrate shall obtain an affidavit of undertaking from the defacto complainant stating that in the event of the petitioner succeeding in the case, the amount so deposited by the petitioner will be returned to him and after obtaining such an affidavit of undertaking from the defacto complainant, the trial court shall disburse the said amount to him in lieu of the petitioner is directed to deposit a sum of Rs.5,00,000/- in favour of the defacto complainant either through RTGS/NEFT/Cash, without prejudice to his defence before the trial court and the learned Judicial Magistrate, after perusing the challan/receipt received from the defacto complainant, shall accept the sureties furnished by the petitioner.
