Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2nd and 3rd respondents to take steps to measure and demarcate the property being all that piece and parcel of land in Thonnakuttahalli Village, Pennagaram Taluk, Dharmapuri District comprised in S.No.735/3B1 to an extent of 0.33.34 cents and S.No.735/4A to an extent of 0.35.81 hectare in application No.2024/0123/05/007817 dated 18.12.2024 to put the fencing the property with the help of the 4th respondent within a time frame fixed by this Court. ORDER

This Writ Petition has been filed seeking a direction to the 2nd and 3rd respondents to take steps to measure and demarcate the property being all that piece and parcel of land in Thonnakuttahalli Village, Pennagaram Taluk, Dharmapuri District comprised in S.No.735/3B1 to an extent of 0.33.34 cents and S.No.735/4A to an extent of 0.35.81 hectare in application 2/6

No.2024/0123/05/007817 dated 18.12.2024 to fence the property with the help of the 4th respondent within a time frame fixed by this Court.

2. The petitioner submitted an application before respondents 1 & 2 to survey the aforementioned land. So far they did not take any step to survey and demarcate the aforementioned land. Hence, this writ petition.

In view of the above, the second respondent is directed to survey the aforesaid land based on the title deed produced by the petitioner, after issuance of notice to the adjacent land owners and counter parties, if there are, and to serve the survey report to the petitioner within a period of six weeks from the date of receipt of this order. It is made clear that, if the surveyor concerned is obstructed by third parties while surveying the subject land, the said surveyor can approach the jurisdictional police seeking police aid and on such request, the jurisdictional police shall provide adequate police protection to the surveyor. It is also made clear that the said surveyor can only survey the said land and police protection cannot be sought in respect of fencing the subject land. 3/6

4. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
