PRAYER:

Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent herein to issue patta in respect of the agricultural land belongs to the petitioner to an extent of 2.86 acres out of 3.35 acres comprised in New Survey No.41/2, sitauted at Sivanandhipuram, Peykanatham Firka, Kurinchipadi Taluk, Cuddalore District pursuant to the representation of the petitioner dated 30.09.2016.

Mr.E.Balamurugan, learned Additional Government Pleader takes notice for the respondents. By consent of the parties, the main writ petition is taken up for final disposal at the admission stage itself.

2. Heard both sides.

3. The petitioner seeks for a mandamus, directing the second respondent to issue patta in respect of the agricultural land situated at Sivanandhipuram, Peykanatham Firka, Kurinchipadi Taluk, Cuddalore District, measuring to an extent of 2.86 acres https://hcservices.ecourts.gov.in/hcservices/

out of 3.35 acres comprised in New Survey No.41/2, based on her representation dated 30.09.2016.

4. The grievance of the petitioner is that the said request has not been considered so far. At this stage, this Court is not expressing any view on the merits of the claim made by the petitioner, as it is for the second respondent to consider and decide the same on merits and in accordance with law. Accordingly, the writ petition is disposed of, only by directing the second respondent to consider the representation of the petitioner dated 30.09.2016 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the second respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
