ORDER

When the Writ Petition was taken up for hearing today, learned counsel for the respondent submitted that the writ petition is not maintainable.

As the relief sought for can be agitated before the Civil Court, this Writ Petition is dismissed with liberty to the petitioner to work out his remedy before the competent Civil Court. No costs. Consequently, connected W.P.M.P.No.36768 of 2004 is closed.
