O R D E R
The present criminal original petition has been filed seeking a direction to the 2nd respondent Police to register a case on the basis of the complaint given by the petitioner dated 06.08.2015.
2. In the petition, it has been stated that the petitioner is a retired Teacher and he is residing at 53/47, Netaji Street, New Lakshmipuram, Kolathur Post, Chennai with his wife, who is also a retired Teacher along with his two daughters and his granddaughter Susmitha, aged about 6 years. The petitioner's son-in-law Mr.Sivakumar, who was working at Kuwait had quarrelled with the petitioner's daughter and abused her. Thereafter, he started to threaten the petitioner and his daughter over phone and the petitioner's daughter has filed a divorce petition before the Family Court, Chennai. Whenever, they come to the Family Court, he threatened the petitioner and his daughter with dire consequences. When the petitioner came to the Family Court on 31.07.2015, the said Sivakumar along with two rowdies threatened the petitioner with knife and threatened https://hcservices.ecourts.gov.in/hcservices/
to withdraw the maintenance case. Therefore, the petitioner has lodged a complaint on 06.08.2015. But, the said complaint was not registered so far. Hence, the petitioner has filed the present criminal original petition.
3. The learned Additional Public Prosecutor submitted that the complaint was sent only by post and if the petitioner gives a fresh complaint, necessary action will be taken.
4. This Court without going into the merits of the claim of the petitioner, directs the petitioner to give a fresh complaint along with the copy of this order before the 2nd respondent police within a period of one week from the date of receipt of a copy of this order, and on receipt of the same, the 2nd respondent is directed to enquire the same and dispose of it in accordance with law, as early as possible.
6. This criminal original petition is disposed of accordingly.
