Side) For Intervenor : MR.M.ARUNACHALAM Advocate PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- (The case has been heard through video conference) Today, when this matter is came up for hearing under the caption, " for reporting compliance" the learned counsel for the petitioner submits that in an earlier occasion, while granting bail to the petitioners, this court, imposed condition on the petitioner to deposit of Rs.13,00,000/-. However, the said condition has not been complied with by the petitioners.
2. This Court granted anticipatory bail to the petitioners on the condition that the petitioner shall deposit Rs.13,00,000 (Rupees Thirteen Lakhs Only) by way of installments, to the credit of Cr.No.06 of 2021 before the learned Judicial Magistrate No.II, Panruti, Cuddalore District,, within a period of four weeks from the date of receipt of a copy of this order. On such deposit being made, the learned Judicial Magistrate No.II, Panruti, Cuddalore District, https://hcservices.ecourts.gov.in/hcservices/
release the vehicle in favour of the petitioner, shall obtain an affidavit of undertaking from the defacto complainant stating that in the event of the petitioners succeeding the case, the amount of Rs.13,00,000/- deposited by the petitioners to the credit of Cr.No.06 of 2021 will be returned to the petitioners and after obtaining such affidavit of undertaking from the defacto complainant, shall disburse the said amount to the defacto complainant within a period of two weeks thereafter, however, the said condition, it is stated that has not been complied. In such circumstances, the anticipatory bail granted to the petitioners is cancelled.
3. If any petition is filed for return of property, the learned Judicial Magistrate No.II, Panruti, Cuddalore District is directed not to hand over the vehicle to the petitioners.
