ORDER

The petitioner has filed the contempt petition, to punish the respondents for disobeying the order of this Court dated 29.11.2023 passed in W.P.No.33315 of 2023.

2. It is submitted by the learned counsel for the petitioner that the petitioner is the sixth respondent in W.P.No.33315 of 2023. While disposing the said writ petition, this Court directed the respondents 1 to 3 therein/respondents 2 to 4 herein, to consider the petitioner's representation dated 19.09.2023, after issuing notice to the petitioner therein, the sixth respondent therein who is the present contempt petitioner and other adjacent land owners and interested parties/rival 2/5

claimants if any as the case may be and pass the order. The main contention of the petitioner is that without issuing notice to the petitioner/sixth respondent in W.P.No.33315 of 2023, the official respondents have passed the order. Hence the petitioner/sixth respondent in W.P.No.33315 of 2023 has filed the present contempt petition.

It is informed by the learned Special Government Pleader appearing for the respondents 2 to 4 that the order of this Court dated 29.11.2023 passed in W.P.No.33315 of 2023 has been complied with and he has also filed the copy of the proceedings passed by the third respondent with regard to the petitioners' representation.

4. On a perusal of the order passed by the third respondent, it is seen that there is an appellate remedy is available before the appellate authority. If the contempt petitioner is aggrieved with the order passed by the third respondent herein, he can file an appeal before the appellate authority.

5. With the above observation and direction, this Contempt Petition is closed. The petitioner is at liberty to work out his remedy in the manner known to law.
