PRAYER: Writ Petition filed under Article 226 of Constitution of India praying for the issuance of the Writ of Mandamus, directing the third respondent to permit the petitioner and Adhidravidar (Dalits) colony peoples to participate in the event of Arulmigu Swarnapurishwarar Sivan koil and Rajanarayana Thirukovil festival and other Hindu Religious Charitable Endowments Temples festival at Kogaiyur Village, Chinnasalem Taluk, Kallakurichi District which scheduled to be held on 05.05.2023 and 06.05.2023 by considering the petitioner representation dated 26.04.2023 to secure ends of justice.

ORDER
This Writ Petition has been filed for the issuance of Writ of Mandamus, directing the third respondent to permit the petitioner and Adhidravidar (Dalits) colony peoples to participate in the event of Arulmigu Swarnapurishwarar Sivan koil and Rajanarayana Thirukovil festival and other Hindu Religious Charitable Endowments Temples festival at Kogaiyur Village, Chinnasalem Taluk,
Kallakurichi District which scheduled to be held on 05.05.2023 and 06.05.2023 by considering the petitioner representation dated 26.04.2023.

According to the learned counsel for the petitioner there is a festival to be conducted on 05.05.2023 and 06.05.2023 at Arulmigu Swarnapurishwarar Sivan koil and Rajanarayana Thirukovil festival and in other Hindu Religious Charitable Endowments Temples at Kogaiyur Village, Chinnasalem Taluk, Kallakurichi District. Adhidravidar colony people are prevented from participating in these temple festivals. Therefore, this petition.
3. In response, the learned Government Advocate (Crl.side) submitted that there is no proposal for the festival to be conducted on 05.05.2023 and 06.05.2023. He further submitted that in a peace committee meeting conducted between the Adhidravidar community people and other community people, a decision was taken on 25.04.2023 that no temple festival is to be held this year, but the temple festival will be held next year.
4. Considered the rival submissions and perused the records.
5. No body has any right to prevent the Adhidravidar (Dalits) colony people to participate in any temple festival, especially the temples under the control of Hindu Religious Charitable Endowments Department. Therefore, if at all any temple festival is conducted in the aforesaid temples and other Hindu Religious Charitable Endowments Temples, it must be ensured that the people from Adhidravidar (Dalits) colony should be permitted to participate in the festivals.
6. Accordingly, this Writ Petition is disposed of. Consequently, connected Miscellaneous petition is closed. No costs.
