ORDER
Challenging the order of the 3rd respondent/Deputy Tahsildar-cumExecutive Magistrate, Yanam, refusing to issue EWS Certificate to the petitioner, the present writ petition has been filed. 2.The petitioner claims to be an EWS candidate from Yanam and he applied for the post of Assistant (Group B) under the Government of Puducherry vide Notification dated 22.08.2024 and he cleared both Tier-1 and Tier-2 examinations and was placed in the waiting list with 62.75 marks under EWS Quota. It is the contention of the petitioner that her family owns only 100 sq.m. of agricultural land and as per Office Memorandum of the year 2019 with regard to EWS Criteria, the extent of her family property is well within the prescribed limits and therefore, she is qualified to get EWS Certificate.
When the petitioner applied for the same before the 3rd respondent, the 3rd respondent rejected the claim of the petitioner by the impugned order dated 16.03.2026. Therefore, the petitioner filed an Appeal against the impugned order of the 3rd respondent before the 2nd respondent and the same is still pending.

3.Learned counsel for the petitioner would submit that the 3rd respondent has simply rejected the claim of the petitioner by incorrectly treating the land as exceeding the permissible residential plot limit, without properly considering its classification as agricultural land and the provisions of the 2019 Official Memorandum. The learned counsel would further submit that the 1st respondent has fixed the deadline for submission of EWS Certificate and therefore, if the Certificate is not issued within the deadline, the provisional selection of the petitioner would be cancelled and hence, prays for appropriate orders. 4.Learned Additional Government Pleader (Pondicherry) appearing for the respondents would submit that the petitioner has already filed an Appeal dated 18.03.
2026 before the 2nd respondent and the 2nd respondent may be directed to dispose of the Appeal within a time frame. 5.In view of the submissions made on either side, since the Appeal already filed by the petitioner as against the impugned order before the 2nd respondent is still pending, the 2nd respondent is directed to consider the Appeal filed by the petitioner dated 18.03.
