2. The plaintiff is the appellant herein.

3. Suit for partition was filed and the same was dismissed, hence the appeal. Pending appeal, he has filed the above C.M.P for injunction restraining the 4th respondent from alienating the suit property.

4. Heard both sides.

5. Any alienation if any made will be governed under Section 53 of the Transfer of Property Act on the principal of Lis Pendens.

6. Accordingly, this petition is ordered.
