Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed by this Hon'ble Court in Crl.M.P.NO.13203 of 2016 in Crl.Appeal No. 810 of 2016 dated 12.12.2016 directing the petitioner to report before the Trial Court on the 1st working day of every month at 10.30 a.m. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.RAMAKRISHNAN Advocate for M/S.WARAON AND SAI RAMS, Advocate for the petitioner and of MR.K.SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- This petition has been filed to relax the condition imposed by this court in Crl.M.P.No.13203 of 2016 in Crl.A.No.810 of 2016 dated 12.12.2016 directing the petitioner to appear before the trial Court on the first working day of every Month at 10.30 a.m, until further orders.

2. The learned counsel for the petitioner would submit that the petitioner is a permanent resident of Bangalore and he is aged about 70 years and having eye problem, due to which, it is very difficult to travel from Bangalore to Chennai and he has to take assistance of another person. Further, due to his old age he has been advised by the doctor not to travel. He would also submit that in due compliance of the order, the petitioner has been regularly appearing before the trial court for the past 1- 1/2 years and would pray that considering old age and health condition of the petitioner, the condition imposed on the petitioner to report every month before the trial court may be modified.

3. The learned Special Public Prosecutor for CBI Cases would submit that the petitioner has been duly complying with the condition on appearing before the trial Court on the first working day of every month.

4. Taking into consideration of the submissions made by both the counsels, the condition imposed by this court in Crl.M.P.No.13203 of 2016 in Crl.A.No.810 of 2016 dated 12.12.2016 is modified to the effect that the petitioner shall appear before the trial court once in three months on the first working day of the particular month at 10.30 a.m until further orders, starting from the month of November 2018. -sd/- 19/09/2018 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
