Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st and 2nd respondents to conduct enquiry and pass appropriate orders on the representation dated 30.07.2020 made by the petitioner herein to cancel the patta issued in favour of the 5th respondent for Kuttai water body in Survey No.16, Molasi Village, Tiruchengode Taluk, Namakkal District within stipulated time period as may be fixed by this Court.

ORDER

(1)This writ petition has been filed for the issue of a writ of mandamus, directing the respondents to act upon the representation made by the petitioner on 30.07.2020 and to https://hcservices.ecourts.gov.in/hcservices/

conduct an enquiry and cancel the patta issued in favour of the 5th respondent.

(2)Mr.Annai Ezhil, learned Government Advocate accepting notice on behalf of the respondents 1 to 4 submitted that the representation made by the petitioner, has been taken on file by the 3rd respondent and the has been fixed on 06.10.2020 at 11.00 a.m. The written instructions received by the learned Government Advocate, was also circulated through E-Mail. Learned Special Government Pleader submitted that the petitioner can be present during the enquiry along with all the relevant documents.

(3)Taking into consideration, the facts and circumstances of the case and also of the fact that the 3rd respondent has already fixed the date of enquiry, there shall be a direction to the 3rd respondent to conduct the enquiry after giving sufficient opportunity to the petitioner and the 5th respondent and pass appropriate orders strictly in accordance with law within a period of six weeks from the date of receipt of a copy of this order.

(4)This writ petition is disposed of with the above direction. No costs. Consequently, the connected miscellaneous petition is closed.
