CRIME NO.119/2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the order dated 25.06.2021 passed by this Honourable court in the above Crl.OP.No.10555 of 2021 with respect to the condition directing the petitioners to surrender the mobile phone and pass such or further orders as this Honble court may deem fit and necessary. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.P.MANI, Advocate for the petitioner and of THE PUBLIC PROSECUTOR on behalf of the Respondents the court made the following order:- This petition has been filed to modify the condition in Crl.O.P.No.10555 of 2021 by order dated 25.06.2021 directing the petitioners to surrender the mobile phone.

2. The learned counsel for the petitioners would submit that the petitioners have been complying with the conditions regularly and hence, he seeks for modification of the condition. He further submitted that the petitioners had not snatched the mobile phone and they are not in possession of the same. He further submitted that as per the earlier order dated 25.06.2021, the petitioners had deposited a sum of Rs.10,000/- (Rupees Ten Thousand

only) each, to the credit of the Medical Officer, Ariyalur Government Hospital, Ariyalur District.

3. The learned Government Advocate (Crl.Side) would also submit that the petitioners have been complying with the conditions.

4. The above submission of the learned counsel for the petitioners cannot be considered. However, the condition imposed on the petitioners in Crl.O.P.No.10555 of 2021 by order dated 25.06.2021, is modified to the effect that the petitioners shall pay a fine amount of Rs.15,000/-(Rupees Fifteen Thousand only) to the defacto complainant/Sub-Inspector of Police within a period of two weeks from the date of receipt of a copy of this order.

5. With the above directions, this criminal original petition is accordingly ordered.
