On the other hand, neither the respondent nor his counsel is not appeared before this Court for representing their case.
2. It is the contention of the learned counsel appearing on behalf of the applicant that the Date of Birth of the minor child, is falls on 23.02.2021 and therefore, being the mother, the applicant wanted to spend some considerable time with the minor child. In the said circumstances, only on considering the nature of the prayer sought by the applicant, this Court directed the learned counsel appearing for the respondent, to appear before this Court, but the said direction is not complied with. 3. More than that, already some visitation rights have been granted in favour of the applicant and the same has been sincerely followed by the applicant, till date. Therefore, considering the facts and circumstances of the case, the applicant / mother shall have the custody of the minor child from 10.00a.m. on 22.02.2021 to 4.00 p.m. on 24.02.2021.
4. In view of the above, this Application is ordered accordingly.
