A.No.2140 of 2022 & CS.No.91 of 2022 KRISHNAN RAMASAMY, J., The above suit has been filed for partition and separate possession of the suit property situated at Kasturi Ranga Road, Alwarpet, Chennai18. 2.The present application has been filed to permit the applicants to file necessary suit at a later point of time, if found necessary as regards the other properties belonging to the joint family. 3.The learned counsel for the applicants/plaintiffs has submitted that the suit property belonging to the joint family. However, the suit scheduled property, which is situated within the city of Chennai and the family members and their children require a permanent place to live in as per their requirements. He further submitted that there are also other properties belonging to the joint family. However, the present suit has been filed for partition and separate possession only in respect of the property situated at Kasturi Ranga Road, Alwarpet, Chennai-18 and as 1/2 https://www.mhc.tn.gov.in/judis

KRISHNAN RAMASAMY, J., dn regards other properties belonging to the joint family are concerned, the applicants seek leave of this Court to file separate suit for partition if found necessary at a later date.

4. Considering the submissions made by the learned counsel on either side and also the averments made in the affidavit filed in support of the petition, this Court is inclined to grant leave to the applicants/plaintiffs to file necessary suit at later time whenever found necessary as regards the other properties belonging to the joint family.

5. Accordingly, this application is allowed.
