Mr.A.K.Raghavulu, learned counsel for the petitioner, on instructions, submitted that he is giving up the 5th respondent in the appeal.

2.The submission made by the learned counsel for the petitioner/appellant is recorded. Hence, the 5th respondent is given up in the petition as well as in the appeal.

3.There is a delay of 89 days in filing the appeal.

4.Mr.D.Baskar, learned counsel for the 1st respondent has no objection for condoning the delay.

5.The notices sent to the respondents 2 & 4 were duly served and their names have been printed in the cause list. However, none appeared for them. The notices sent to respondents 3 & 6 were refused by the respondents.

6.We are satisfied with the reasons stated in the affidavit filed in support of the petition. The delay is condoned. The petition is ordered.
