This writ petition has been filed seeking issuance of a writ of mandamus directing the respondents 2 and 3 to act upon the online application submitted by the petitioner on 21.03.2025 wherein the petitioner is seeking for survey of the subject property and for demarcation of boundaries and for fencing the property.
2. Heard Mr.P.Thirumalaivasan, learned counsel for petitioner, Mr.A.Selvendran, learned Special Government Pleader appearing for respondents 1 to 3 and Mr.V.J.Priyadarsana, learned Government Advocate [Crl.side] appearing for fourth respondent.
3. The petitioner is relying upon the sale deed dated 2/4
01.07.2009 and also the patta issued in patta No.1422 in the name of the petitioner. The petitioner submitted an online application on 21.03.2025 for survey of the property and for demarcation of boundaries in order to fence the property. Since the same was not considered, the present writ petition has been filed before this Court.
4. Taking into consideration the facts and circumstances of the case and the materials placed before this Court, there shall be a direction to the first respondent to act upon the online application submitted by the petitioner on 21.03.2025 and conduct the survey in the subject property based on the title document and the patta that stands in the name of the petitioner. This process shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order. If there are any other interested parties, such survey shall be conducted in their presence. Ultimately, if the survey is conducted and the boundaries are demarcated, the petitioner can proceed to fence the property. In the said process, if any police protection is required, the same shall be provided by the fourth respondent.
