Respondent Prayer:- Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, to call for the records of the Respondent herein in PAN: AAECS7315R dt.29.12.2017 passed by the respondent for the Assessment Year 2015-16 dated 29.12.2017 and quash the Order dated 29.12.2017 passed therein.

ORDER

The petitioner wishes to withdraw this writ petition and avail of statutory remedy and has made an endorsement in this regard. It is also requested that since the petitioner has been enjoying an interim stay since the inception of the writ petition, the appeal to be filed may be taken to have been filed within limitation. Both requests are accepted. The petitioner is permitted to file an appeal within a period of two weeks from today. Such appeal, if filed within the timeline as aforesaid, shall be taken on file by the office of the Commissioner of Income Tax (Appeals) without reference to limitation and heard and disposed in accordance with law. It is made clear that all contentions of the assessee/petitioner are left open to be agitated in appeal.
