This petition is filed to condone the delay of 398 days in filing the appeal.

2. Heard the counsel for the petitioner. The first respondent was exparte before the trial court.

We have also heard the learned counsel for the 2nd respondent.

3. In view of the reasons found mentioned in the affidavit filed in support of the Miscellaneous Petition, the delay is condoned.

The Miscellaneous Petition is allowed.
