ORDER

Learned counsel for the applicant seeks liberty for the applicant to approach the Arbitral Tribunal and seek for a similar relief as sought in this application under Section 17 of the Arbitration and Conciliation Act, 1996.

2. Learned counsel for the applicant has also submitted that already the ABDUL QUDDHOSE,J.

Arb.Appln.No.583 of 2025 vsi applicant has filed an application seeking for a similar relief before the Arbitral Tribunal and the same has not been disposed of by the Arbitral Tribunal, despite urgency being shown by the applicant.

3. No prejudice would be caused to either of the parties to the dispute if a direction is issued to the Arbitral Tribunal to dispose of Section 17 Application filed by the applicant if the same is pending seeking for the very same relief that has been sought for in this application, after hearing the other party on merits and in accordance with law.

4. Accordingly, this Application is disposed of by directing the Arbitral Tribunal to pass final orders on merits and in accordance with law on the applicant's application filed under Section 17 of the Arbitration and Conciliation Act, 1996, seeking for a similar relief, which according to the applicant is still pending before the Arbital Tribunal, as expeditiously a possible.
