401 of 2016 pending on the file of this Honourable Court granting the petitioner exemption from appearing before the XI Additional Sessions Judge cum Special Court for CBI Cases pertaining to Bank Fraud Cases on the first working day of every month for a period of 7 (seven) months Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.K.P.ANANTHA KRISHNA Advocate for the petitioner and of MR.K,SRINIVASAN SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- The above petition is filed praying to relax the condition imposed upon the petitioner on 08.06.2016 in Crl.M.P.No. 6062 of 2016 in Crl.A.No.

401 of 2016, to appear before the XI Additional Sessions Judge cum Special Court for CBI Cases, Chennai on the first working day of every month at 10.30 a.m. pending disposal of the above appeal in Crl.Appeal No.401 of 2016.

2. It is submitted by the learned counsel for the petitioner that the petitioner's daughter is in a family way and she is residing at Atlanta, Georgia State, USA and during her hospitalization, the petitioner has to be present to help her in final stages of pregnancy. Further, the petitioner sought permission of this court to travel to USA during the months of June, July and August.

3. Learned Special Public Prosecutor appearing for the respondent submits that the petitioner has been complying with the conditions already imposed by this court without any default

and he has no serious objection to permit the petitioner to travel abroad with direction to comply with conditions to be stipulated by this court.

4. In the circumstances, this court is inclined to modify the order dated 08.06.2016 passed in Crl.M.P.No.6062 of 2016 in Crl.A.No.401 of 2016. Accordingly, the petitioner shall appear before the XI Additional Sessions Judge cum Special Court for CBI Cases, Chennai at 10.30 a.m., on the first working day, once in three months, pending appeal. Further, the petitioner is permitted to travel to USA in the months of June, July and August and shall return from USA on or before 31st August, 2017 and further to appear before the concerned court on the expiry of three months period. The petitioner is also directed to comply with the following conditions:- (i) Permission is accorded to the petitioner to travel abroad for a period of three months from 01.05.2017 with a direction that he shall return on the expiry of three months. (ii) The petitioner is directed to submit his tour plan/schedule before the respondent/concerned court, 15 days prior to the date of his journey.

(iii) The petitioner is directed to submit all the certified copy of the travel documents viz., Visa, Air Ticket etc., related to his journey before the respondent/concerned court. (iv) The petitioner is directed to furnish his permanent address in India; his full address of stay at USA, contact telephone numbers, E-mail I.D.

etc., before the respondent/concerned court.

(v) The petitioner is directed to give an undertaking by way of an affidavit before the respondent that he will not extend his stay and return to India within the time limit specified by this Court.

Accordingly, this petition is ordered.
