Writ Petition No.13988 of 2019 W.P. No.13988 of 2019 C.V.KARTHIKEYAN.J, It would be advantageous for the petitioner to file a suit, in respect of the claim made in the affidavit filed in support of the Writ Petition. 2.The learned counsel relies on certain documents. But those documents can be considered as evidence, only subject to admissibility and relevance and only when the same are proved in the manner known to law, which requires process of trial before the trial Court and only when the suit is instituted.

3. The learned counsel for the petitioner, states that the petitioner is in penury and could not file a suit.

4.Under the provisions of Civil Procedure Code, as an indigent person, the petitioner can institute a suit.

5.The learned counsel for the petitioner seeks time for getting instructions on this issue.
