ORDER

This application has been filed by the applicant to set aside the order passed by this Court on 11.08.2022 and restore the Suit against the respondents 1, 2 and 5 / defendants 1, 2, 5, which was dismissed for default.

2.According to the applicant, he is the plaintiff in the main Suit and the Suit has been filed for the relief of specific performance. For non payment of batta, this Court dismissed the Suit for default as against the defendant 1, 2 and 5. Therefore, the present application.

3.Other side appeared and they expressed no objection. 4.Considering the reasons stated in the affidavit and in order to afford one more opportunity to the applicant to contest the case, this application stands allowed.
