ORDER

The petitioner claiming to be a victim, who allegedly cheated by the accused in Cr.No.16 of 2022, corresponding to CC.No.7 of 2022 on the file of the Special Judge No.I TNPID Court, Chennai, has filed this petition seeking to include him as a witness.

2. The contention of the petitioner is that he was cheated by the accused to the tune of Rs.2.205 crores. Though he had lodged a complaint with the respondent Police and produced documents available with him to establish that he his a victim, the respondent Police did not consider the same. After completion of investigation in Crime No.16 of 2022, a charge sheet was filed. On perusal of the same, it is found that the petitioner's name was not included in the list of witnesses. Hence, the present petition has been filed.

3. The learned Government Advocate (Crl. Side) submitted that further investigation is going on in C.C.No.7 of 2022 and in the course of such further investigation, the petitioner's complaint was already considered. It is further submitted that the petitioner has been contacted and steps are being taken to include him as a witness.

4. The learned counsel for the petitioner submitted that the petitioner's plea that he should be added as a witness has been pending from 2023. Though the petitioner was contacted over phone, neither he was formally summoned nor the documents available with him were collected. Further, the petitioner earlier approached this Court in Crl.OP.No.7220 of 2023 seeking to conduct further investigation in Crime No.16 of 2022, wherein this Court recorded the statement of the petitioner that the petitioner is a victim, who had invested

around 2.205 crores and he has not been shown as a witness and no document has been collected from him. Despite the order passed by this Court on 03.04.2023, so far, the petitioner has not been summoned.

5. In reply, the learned Government Advocate (Crl. Side) fairly submitted that the petitioner will be treated as a witness and that summons will be issued to him shortly. It is further stated that his statement will be recorded, the documents will be collected from the petitioner and he will be included as a witness in C.C.No.7 of 2022 and same will be placed before the concerned Court.

6. Recording the above submission of the learned Government Advocate (Crl. Side), this Criminal Original Petition is disposed of with a direction that the respondent Police shall complete the aforesaid exercise, namely, issuing summons to the petitioner, recording his statement, collecting relevant documents, and including him as a witness in C.C.No.7 of 2022 within a period of three weeks from the date of receipt of a copy of this order. 17-04-2026 Index: Yes/No Speaking/Non-speaking order PVS
